The Klingenstein Philanthropies (along with its subsidiaries, affiliates and foundations, collectively, “Foundation,” “we,” “our,” or “us“) owns and/or operates this website, along with the websites located at www.klingfund.org, www.ktgf.org, and www.sadieandharrydavis.org (together with any other websites owned and/or operated by the Foundation, the “Sites“). The Sites are provided by the Foundation to the person accessing the Sites (“you” or “your“). 

The Foundation has created this privacy policy to explain what information we gather from you when you visit our Sites or otherwise interact with us, how we may use this information, to whom and under what circumstances we may disclose it, and the security approaches we use to protect your information (this “Privacy Policy“). As used in this Privacy Policy, “Personal Information” includes anything that identifies, relates to, describes, is capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular individual or household. Your access to, and use of, the Sites is also subject to the Foundation’s Terms of Use, available at uniform resource locator www.klingenstein.org (as such terms of use may be modified from time to time as described therein, the “Terms of Use“). This Privacy Policy is incorporated and made part of the Foundation’s Terms of Use. 

By using the Sites, you consent to the collection, use, processing, transfer, and disclosure of your information by the Foundation in accordance with this Privacy Policy. If you do not agree to the Privacy Policy, please do not visit or use the Sites. We may modify this Privacy Policy at any time and will post the current version on the Sites. We encourage you to periodically review our Privacy Policy to stay informed about how we are using the information we collect.

  • You may visit the Sites without providing such information, but you will not be able to access or utilize some of the pages and features that are currently on our Sites, or that we may put on our Sites in the future.

Aggregate Information and De-identified Information: We may aggregate the personal information that we collect identified above for purposes of statistical analysis, research, and other purposes. In addition, non-Personal Information or de-identified information that we collect from you may be provided to other parties for marketing, advertising, or other uses. 4 

Right to Opt-Out or Withdraw Consent: In some jurisdictions, individuals may have the right to opt-in or withdraw consent for certain uses. If you reside in such jurisdictions, you may have additional rights which are detailed in the “Access, Correction and Deletion of Personal Information” section below. 

If you do not wish to receive communications from us notifying you of Foundation activities, opportunities, and/or programs, you can opt-out of receiving these communications by following the instructions contained in the messages you receive. Even if you opt-out of receiving these messages, we reserve the right to send you certain communications relating to the services we provide, and we may send you service announcements and administrative messages. We do not offer you the opportunity to opt-out of receiving those communications. 

Disclosure with Other Third Parties: Except to the extent expressly stated in this Privacy Policy, we generally do not sell, trade, or otherwise transfer to outside parties your Personal Information identified above, unless we provide you with advance notice or you direct us to share your Personal Information. The term “outside parties” does not include our affiliates, website hosting or payment processing partners, third-party vendors, and other parties who assist us in operating the Sites, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. 

2. Use of “Cookies” or Similar Tools 

Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. We use cookies to help us remember and process the items in your applications and programs. Cookies are also used to help us understand your preferences based on previous or current activity on the Sites, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about traffic on the Sites and interaction with the Sites so that we can offer better experiences with the Sites and our offerings in the future.

If you choose, you can set your browser to reject cookies or you can manually delete individual cookies or all of the cookies on your computer by following your browser’s help file directions. However, if your browser is set to reject cookies or you manually delete cookies, you may have some trouble accessing and using some of the pages and features that are currently on our Sites, or that we may put on our Sites in the future. Note that browser-management tools for cookies are outside of our control and we cannot guarantee their effectiveness. Because there is not yet a common understanding of how to interpret web browser-based “Do Not Track” (“DNT”) signals other than cookies, we do not currently respond to undefined “DNT” signals to the Sites. 

We may combine the information we collect through cookies with other information we have collected from you or information from other sources. 

3. Access, Correction and Deletion of Personal Information 

We respect your right to access and correct your Personal Information. You may access your Personal Information by signing into your account. From there, you may be able to correct or modify your information through an available interface or the submission of an updated application, entry form, renewal, or other applicable form and, in any event, you may contact us as indicated in the “Contact Us” section below to request that we correct or modify such information. You may also exercise your rights, subject to applicable laws, to request that we delete or restrict access to your personal data. We may need to retain it for legally permitted purposes, and this will be explained to you if necessary.

4. Retention of Personal Information 

Personal Information that we collect, access, or process will be retained only as long as necessary for the fulfilment of the purposes for which it was collected, unless otherwise provided in agreements between you and the Foundation or as required or authorized by law. Personal Information that is no longer required to fulfill the identified purposes will be destroyed, erased, or made de-identified. 

5. Safeguarding Your Personal Information 

We maintain reasonable and appropriate measures designed to maintain information we collect in a secure manner. We have taken certain physical, electronic, and administrative steps to safeguard and secure the information we collect from visitors to the Sites. Even though we follow reasonable procedures to try to protect the information in our possession, no security system is perfect, and we cannot promise, and you should not expect, that your information will be secure in all circumstances. 

You are responsible for taking reasonable steps to maintain the confidentiality of your user ID/username and password, and you are responsible for all activities under your account that you can reasonably control. You agree to promptly notify us of any unauthorized use of your user ID/username, password, or other account information, or of any other breach of security that you become aware of involving your account or our Sites or services. 

6. Privacy and Third-Party Links 

This Privacy Policy applies solely to information collected through the Sites. To provide you with increased value, we may include third-party links on the Sites, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy policy posted on any external site before disclosing any Personal Information. Please contact those websites directly if you have any questions about their privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of the Sites and welcome any feedback about these linked sites (including if a specific link does not work). 

7. Online Policy Only 

This Privacy Policy applies only to information collected through the Sites and not to information collected offline. 

8. Changes to This Privacy Policy 

We may change this Privacy Policy from time to time, including as required to keep current with rules and regulations, new technologies, and security standards. When we do, we will post the change(s) on our Sites. If we change the policy in a material and retroactive manner, we will provide appropriate notice to you. 

9. Children’s Privacy 

We do not knowingly intend to collect Personal Information from children under 13 years of age. If a child has provided us with Personal Information, a parent or guardian of that child may contact us in writing at the address indicated in the “Contact Us” section below. Your letter must clearly state that it is a “Request for Child Information Removal” and the name and age of the child must be contained in the body of the message. We will then make reasonable efforts to delete the child’s information from the database that stores information for the Sites. 

Further, if you are under 18 years of age and have an account with us, you have the right to request removal of unwanted information that you publicly post on the Sites. To request removal 6 

of such information, please contact us in writing at the address indicated in the “Contact Us” section below. Your letter must clearly state that it is for “Removal of Minor Information”. Upon receiving such a request, we will make sure that the information is not publicly available on the Sites, but the information may not be completely or comprehensively removed from our systems and databases. 

10. Your California Privacy Rights 

Under California law, you have a right to request certain information about our disclosure of Personal Information to third parties for their own direct marketing purposes during the preceding calendar year. Typically, this request is free and may be made once a year. To make such a request, please contact us in writing at the address indicated in the “Contact Us” section below. Your letter must clearly state that it is a “Request for Privacy Information Disclosure”. 

Please note that the California Consumer Privacy Act does not apply to the Foundation as a non-profit. However, we are happy to address questions about the way we collect and use Personal Information as we are able, and please feel free to contact us with your questions as described below under “Contact Us.” 

11. Visitors from Outside the United States—Cross-Border Transfer 

The Sites are hosted in the United States. If you are visiting the Sites from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries in accordance with this Privacy Policy. The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions. By using the Sites and/or providing Personal Information to us, you consent to the transfer of your information to our facilities as described in this Privacy Policy. 

12. Right to Lodge Complaints 

We are transparent about the ways in which we collect and use Personal Information and welcome your questions and concerns. If you have any concern or complaint about the way we handle your Personal Information, please contact us as described in the “Contact Us” section below. To the extent you believe we have not addressed your concerns, or if you otherwise choose to do so for any reason, you have the right to lodge a complaint with a supervisory authority in the country where you reside and/or the United States.
